Terms And Conditions

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of poultry zippy. 

These Terms of Service (“Agreement”) apply to the use of website – www.poultryzippy.com, the poultry zippy mobile application on iOS or Android devices or any other electronic devices.

Definitions and key terms

To help explain things as clearly as possible in this Terms & Conditions, every time any of these terms are referenced, are strictly defined as:

For the purposes of this Agreement, wherever the context so requires "you" or "User" shall mean any person including any natural or legal person who uses the Poultry Zippy app services and the term “we” or "us" shall mean POULTRY ZIPPY.

Application: Application shall mean and include the software and mobile application of poultry zippy accessed through or downloaded from the app store viz., Android or iOS, and accessible from any compatible device.

Content: Content means and includes, without limitation, any information, data, text, pictures, audio, video, GIFs, polls, user profiles, software, tags, graphics, and interactive features generated, provided, or otherwise made accessible either by you or other users or by us or our partners or sponsors on or through the Service/s.

Service: refers to the service provided by POULTRY ZIPPY as described in the relative terms (if available) and on this platform.

Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, payment service (Razor pay) and others who provide our content or whose products or services we think may interest you.

Device: any internet connected device such as a phone, tablet, computer or any other device that can be used to visit Poultry Zippy and use the services.

 

Acceptance

By downloading or using the POULTRY ZIPPY app and website these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to AGRILIP TECHNOLOGY PRIVATE LIMITED.

AGRILIP TECHNOLOGY PRIVATE LIMITED is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

ELIGIBILITY

You hereby represent and warrant that you are at least eighteen (18) years of age or above and are fully able and competent to understand and agree to the terms and conditions set forth in this Agreement.

AGRILIP TECHNOLOGY PVT LTD reserves the right to terminate your account / membership and/or refuse access to the Platform, if you are below eighteen (18) years of age or otherwise incompetent to contract as per applicable law.

Term of use

We grant you a limited, non-exclusive, non-transferable, and revocable license to use our Platform, subject to the terms of this Agreement. You agree that you will not violate any laws in connection with your use of the Platform or interfere with or try to disrupt the Platform.

You are responsible for your use of our Services, and undertake to comply with the applicable laws, and act in strict adherence to our Terms, Privacy Policy and Community Guidelines, as well.

You may access our Services free of charge, or in any such manner which is determined by the Company and is conveyed to you from time to time.

The Company further reserves the right to restrict circulation of any content if the said content violates the Community Guidelines of the App -App – Poultry Zippy App - Community Guidelines. The Company may also suspend or terminate your account for such violation.

The Company is committed to safeguarding the efficiency of the Application. For that reason, we reserve the right to make changes to the Application for maintenance at any time. If such situations cause an interruption of your Services for a reasonable duration, we shall not bear any liability to you and/or to any third parties. We will make attempts on a best-efforts basis to let you beware of any scheduled maintenance to such extent as is possible.

You agree not to: circumvent, remove, degrade, deactivate, or thwart any of the Contents of our Service; use any robot, spider, scraper, or other means to access our Service. You also agree not to decompile, reverse engineer, and disassemble any software or other products or processes accessible through our Service. Additionally, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy, or limit the functionality of our Service. We may terminate or restrict your use of our Service if you violate these Terms or are engaged in any illegal or fraudulent or unethical or unwarranted or otherwise malicious use of our Service.

We do not claim ownership of your content that you post on or through the Service. By submitting, posting, displaying, or communicating Content on or through our Services, you hereby grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, reproduce, process, such Content across all formats, media now known, or which may come into existence later.

You represent and warrant that you have, or have obtained, all rights, licenses, necessary authorizations required to grant the rights granted herein for any Content that you submit, or post, or display, or communicate through our Services and such Content is not subject to copyright or other proprietary rights of third parties unless you are legally entitled to post such Content through necessary permission or otherwise..

We reserve the right to update, modify, alter, amend, these Terms at any time, at our sole discretion.

We do not endorse, support, represent, authorize the circulation of all content published on our Application, and we do not further attest to the accuracy, originality, reliability, legitimacy, completeness, of such Content, as available on our Services.

Intellectual Property and Third-Party Link

AGRILIP TECHNOLOGY PVT LTD is the owner of the brand Poultry Zippy and has the exclusive right, title and ownership of any and all intellectual property rights arising out of its brand.

Poultry Zippy may occasionally post links to third party websites or other services on the Platform. You agree that Poultry Zippy is not responsible or liable for any loss or damage caused as a result of your use of any third-party services linked to from the Platform.

User Account

To access and use the Platform, you may register with us by providing the required information. You are responsible for ensuring the accuracy of this information.

You are responsible for keeping your account secure. We cannot and will not be liable for any loss or damage from your failure to maintain the security of your account. The billing information you provide us, including payment details, billing address and other payment information, is subject to the same accuracy requirements as the rest of your identifying information. Providing false or inaccurate information or using the Platform to further fraud or any unlawful activity is grounds for immediate termination of this Agreement.

Reverse Engineering & Security

You agree not to undertake any of the following actions:

Reverse engineer, or attempt to reverse engineer or disassemble any code or software from or on the Platform;

. Violate the security of the Platform through any unauthorized access, circumvention of encryption or other security tools, data mining or interference to any host, user or network; and

Use the Platform for illegal spam activities, including gathering email addresses and personal information from others or sending any mass commercial emails.

SECURITY OF PAYMENTS AND TRANSACTIONS

Transactions on the Poultry Zippy App are secured and protected by technological means. Any information entered by the User when transacting on the App is encrypted to protect the User against unintentional disclosure to third parties. The User’s credit and debit card or UPI information is not stored by or retained by the Company in any manner. On placing the order, the User will be redirected to the relevant payment gateway, i.e. Razor pay, which is authorized to handle the information provided and is compliant with the regulations and requirements of various banks and institutions and payment franchisees that it is associated with. All the services provided by Razor pay shall be subject to the Terms and Conditions of Razor pay, and Poultry Zippy take no responsibility of any activity of Razor pay. However, we promise to provide assistance and render help for any credit/debit related problems and refunds, on case to case basis.

We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights (“Infringement”) of any person or entity.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to poultryzippy@gmail.com, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged Infringement as detailed below, under “DMCA Notice and Procedure for Copyright Infringement Claims”

You may be held accountable for damages (including costs and attorneys’ fees) for misrepresentation or bad-faith claims on the infringement of any Content found on and/or through Service on your copyright.

These services are provided by company on an “as is” and “as available” basis. company makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content or materials included therein. you expressly agree that your use of these services, their content, and any services or items obtained from us is at your sole risk.

neither company nor any person associated with company makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy, or availability of the services. without limiting the foregoing, neither company nor anyone associated with company represents or warrants that the services, their content, or any services or items obtained through the services will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that the services or the server that makes it available are free of viruses or other harmful components or that the services or any services or items obtained through the services will otherwise meet your needs or expectations.

company hereby disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for particular purpose.

Except as prohibited by law, you will hold us and our officers, directors, employees, and agents harmless for any indirect, punitive, special, incidental, or consequential damage, however it arises (including attorneys’ fees and all related costs and expenses of litigation and arbitration, or at trial or on appeal, if any, whether or not litigation or arbitration is instituted), whether in an action of contract, negligence, or other tortious action, or arising out of or in connection with this agreement, including without limitation any claim for personal injury or property damage, arising from this agreement and any violation by you of any federal, state, or local laws, statutes, rules, or regulations, even if company has been previously advised of the possibility of such damage. except as prohibited by law, if there is liability found on the part of company, it will be limited to the amount paid for the products and/or services, and under no circumstances will there be consequential or punitive damages. some states do not allow the exclusion or limitation of punitive, incidental or consequential damages, so the prior limitation or exclusion may not apply to you.

. Termination

We may terminate or suspend your account and bar access to Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of Terms.

If you wish to terminate your account, you may simply discontinue using Service.

All provisions of Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

These Terms shall be governed and construed in accordance with the laws of India, which governing law applies to agreement without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding Service.

Changes To Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of Service, or the entire Service, to users, including registered users.

SEVERABILITY

If any provision of the Agreement is invalid as per applicable law, held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be excluded from this Agreement and the remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms; provided however that, in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.
 

WAIVER

No provision of this Agreement shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by POULTRY ZIPPY Any consent by POULTRY ZIPPY to, or a waiver by ANIMALL of any breach by you, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
 

APPLICABLE LAW AND DISPUTE SETTLEMENT
 

The parties agree that this Agreement and any contractual obligation between POULTRY ZIPPY and User will be governed by the laws of India.

The courts at karnal shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, User’s use of the Website or the Services or the information to which it gives access.

Agreement to Arbitrate

 

This section applies to any disputeexcept it doesn’t include a dispute relating to claims for injunctive or equitable relief regarding the enforcement or validity of your or poultry zippy intellectual property rights. . The term “dispute” means any dispute, action, or other controversy between you and POULTRY ZIPPY concerning the Services or this agreement, whether in contract, warranty, tort, statute, regulation, ordinance, or any other legal or equitable basis. “Dispute” will be given the broadest possible meaning allowable under law.

Notice of Dispute

In the event of a dispute, you or POULTRY ZIPPY must give the other a Notice of Dispute, which is a written statement that sets forth the name, address, and contact information of the party giving it, the facts giving rise to the dispute, and the relief requested. You must send any Notice of Dispute via email . POULTRY ZIPPY will send any Notice of Dispute to you by mail to your address if we have it, or otherwise to your email address. You and POULTRY ZIPPY will attempt to resolve any dispute through informal negotiation within sixty (60) days from the date the Notice of Dispute is sent. After sixty (60) days, you or POULTRY ZIPPY may commence arbitration.

Binding Arbitration

If you and POULTRY ZIPPY don’t resolve any dispute by informal negotiation, any other effort to resolve the dispute will be conducted exclusively by binding arbitration as described in this section. You are giving up the right to litigate (or participate in as a party or class member) all disputes in court before a judge or jury. The arbitration proceedings shall be in the English language and shall be governed by Arbitration & Conciliation Act, 1996.

Typographical Errors

In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account or other payment account in the amount of the charge.

POULTRY ZIPPY is not responsible for any content, code or any other imprecision.

POULTRY ZIPPY does not provide warranties or guarantees.

In no event shall POULTRY ZIPPY be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice. The POULTRY ZIPPY Service and its contents are provided "as is" and "as available" without any warranty or representations of any kind, whether express or implied. POULTRY ZIPPY is a distributor and not a publisher of the content supplied by third parties; as such, POULTRY ZIPPY exercises no editorial control over such content and makes no warranty or representation as to the accuracy, reliability or currency of any information, content, service or merchandise provided through or accessible via the POULTRY ZIPPY Service. Without limiting the foregoing, POULTRY ZIPPY specifically disclaims all warranties and representations in any content transmitted on or in connection with the POULTRY ZIPPY Service or on sites that may appear as links on the POULTRY ZIPPY Service, or in the products provided as a part of, or otherwise in connection with, the POULTRY ZIPPY Service, including without limitation any warranties of merchantability, fitness for a particular purpose or non-infringement of third party rights. No oral advice or written information given by POULTRY ZIPPY or any of its affiliates, employees, officers, directors, agents, or the like will create a warranty. Price and availability information is subject to change without notice. Without limiting the foregoing, POULTRY ZIPPY does not warrant that the POULTRY ZIPPY Service will be uninterrupted, uncorrupted, timely, or error-free.

COMMUNITY GUIDELINES

1. Hate Speech and Discrimination

Do not post hateful or discriminatory content on POULTRY ZIPPY.

Treat others on POULTRY ZIPPY with dignity, respect, and a sense of empathy. We encourage valid and well-intentioned expressions of healthy disagreement on the platform. We do not allow any forms of hateful, personal attacks, ad hominem speech, or uncivil disagreement which are intended to harm another user or cause them mental stress or suffering. Examples of hateful or discriminatory speech include comments which encourage violence, racially or ethnically objectionable, or disparage anyone based on their national origin, sex, gender identity, sexual orientation, religious affiliation, disabilities, or diseases. We also prohibit content which could encourage other users to share such content. You are not permitted to use hateful images or symbols in your profile image or profile header. You also may not alter your username, display name, or profile bio in such a manner as to appear as if you are engaging in abusive behaviour, or which could be reasonably construed as causing harassment to other user(s) or expressing hate towards a person or group.

 

2. Religiously Offensive Content

Be respectful of the religious beliefs of others.

You must always be respectful of the religious faith and beliefs of others regardless of whether or not they share the same views or beliefs as you. You must not publish anything which is hurtful to the sentiments of others, or which insults their religion or customs and/or causes communal discord.
 

3. Terrorism and Extremism

Do not post content that threatens, encourages or glorifies terrorism.

You must not threaten or promote any dangerous activities on POULTRY ZIPPY. In particular you must not use POULTRY ZIPPY to incite terrorism, secession, acts of violence against person or property or which threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign nations, or insults another nation.You must not post any content that promotes or encourages users to take actions on behalf of a terrorist or anti-national organization, or recruits and disseminates information for, or furthers the objectives of, such organizations. You must also not garner support or approval for the commission of violent acts during lawful protests or create violence-inducing terror and conspiracy networks on the platform.

 

4. Violent Content

Do not post content that threatens, depicts or glorifies violence, or encourages self harm.

You must not use POULTRY ZIPPY to make any direct or indirect threats of physical harm against another person. This includes any threat relating to theft, vandalism, wrongful confinement, bodily, mental or financial harm. POULTRY ZIPPY does not permit its users to post content which involves references to mass murder, violent events, or specific means of violence, in particular where vulnerable communities or groups are the primary targets or victims, or which depicts or glorifies any such actions. POULTRY ZIPPY does not permit the glorification of violence in any manner including but not limited to celebrating events that have caused physical harm to or hurt the sentiments of any person or group. You must refrain from posting content which depicts torture, injury, mental suffering, death, bodily harm, abduction, kidnapping or other forms of violent content. You must also refrain from posting content relating to suicide or self harm, particularly in ways that can be construed as promoting or suggesting this course of action.

 

5. Graphic, Obscene and Sexual Content

Do not post graphic, obscene and/or sexual content on POULTRY ZIPPY.

POULTRY ZIPPY does not tolerate content which is obscene or sexually graphic or which could be seen to be inappropriate for some users. POULTRY ZIPPY does not allow pornographic or peodiphillic content, explicit depictions of deceased persons, violent sexual acts including content depicting rape, and imagery which is excessively gory. POULTRY ZIPPY also has a zero-tolerance policy for any content which depicts sexual content involving children or which may be otherwise harmful to children, or revenge pornography. Any users found posting content of this nature will be immediately reported to the authorities.

 

6. Sexual Harassment and non-consensual nudity

Do not post any content or engage in any activity that might be construed as being sexual harassment other users.

Do not make statements of a sexual nature which are intended to be insulting, harassing, or degrading on the basis of gender, or which make any other person feel uncomfortable. POULTRY ZIPPY does not condone sexual harassment on the platform, including, but not limited to, sexually explicit remarks, or innuendoes directed at any specific person or persons, or the sharing of sexual (or sexually suggestive) information or media in relation to a person without their consent or any content which may may invasive of a person's bodily privacy. We have a zero-tolerance policy against any explicit images or videos that appear to be taken without the consent of another person, or people.

 

7. Cyberbullying

Be kind to others. Don’t be a bully.

POULTRY ZIPPY does not allow users to engage in bullying or harassment on the platform. Bullying could take many forms, including sharing defamatory or libellous content, or sending threatening messages or insults to another POULTRY ZIPPY user. Users must not post content containing personal attacks against other individuals including other POULTRY ZIPPY users. Do not use abusive language, slang, or expletives in any language and in particular do not direct such language at other users. There is a difference between healthy discussion, debate and disagreement and direct personal attacks on another person. You are encouraged to do the former but must not do the latter.

 

8. Invasion of Privacy

Be respectful of the privacy of others.

POULTRY ZIPPY expects users to be respectful towards the privacy of others. You must refrain from publishing sharing, or encouraging the publication of, any personal information of another personor which is invasive of their privacy.

 

9. Illegal Activities

Much like in the real world, don’t break the law when you use POULTRY ZIPPY.

Do not post content which is illegal or which encourages other users to participate in any illegal activity. This includes buying or selling of narcotics, illegal or prescription drugs, alcohol, tobacco products or any other categories of items that are not permitted to be traded between private individuals. You must also not use the platform to offer access to lotteries, gambling, and real money games or encourage money laundering, prostitution, human or child trafficking, organised violence or any other criminal activity. Do not post content that threatens public order, or incites other users to the commit an offence or prevents investigation of any offence.

 

10. Identity Theft and Impersonation

Identity theft is serious. Don’t impersonate any other person.

Do not impersonate or pose as another person, brand, or organization to deceives or misleads users about the origin of the content. You are encouraged to voluntarily verify yourself and ensure that all the details provided in your profile are accurate and do not, in any manner, constitute misrepresentation.

 

11. Misinformation and Fake news

Be truthful and verify information.

Do not knowingly post or share information, which is unverified or false or misleading, but may be perceived as factual. We have a zero-tolerance policy for morphed or manipulated media, including photoshopped pictures or doctored videos. We do not condone content which may affect citizen-centric processes. We also do not permit any content which may interfere with the results of political elections. You must, to the extent possible, make sure that the content that you post on POULTRY ZIPPY is authentic and from a reliable and verifiable source.

 

12. Spamming, Scamming and Phishing

 

Don’t use POULTRY ZIPPY to spam or scam others.

Do not use this platform to manipulate others or to negatively affect their experience on the platform. Do not message other users in bulk from multiple accounts for the purpose of amplifying content or disrupting conversations. Do not use this platform to control prices or to publish information intended to manipulate other users for your own financial gain. Users are also prohibited from trying to deceive others whether on this platform or not, by sharing patently false and untrue information, luring other persons to share sensitive information or requiring them to engage in any other activities which with the intention of misleading or harassing users for financial gain or causing them any other harm.

 

13. Intellectual Property Infringement

 

Respect the intellectual property of others.

POULTRY ZIPPY believes in respecting intellectual property. You must not post content in respect of which others have a patent, copyright (including text, images, music or videos) or a trademark (such as in relation to a brand or a logo that you do not own) or any other proprietary rights, as this may result in infringement of their rights. Before posting something on POULTRY ZIPPY, ensure that it does not belong to another person and that you have the right to do so.

 

14. Malicious Programmes

 

Don’t share malicious programs.

Do not post or share any content on the platform which contains any viruses,malicious programes, or any other computer code, file or program which could cause disruption, inconvenience, harm or loss to other users on the platform, or which is designed to interrupt, destroy or limit the functionality of the platform. Keeping these principles in mind while undertaking any interactions of the platform (including posting content or sending messages to other people) would go long way in making the experience you and our larger community of users have on POULTRY ZIPPY safer and more enjoyable.

In no event shall POULTRY ZIPPY be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents on the Service at any time without prior notice. The POULTRY ZIPPY Service and its contents are provided "as is" and "as available" without any warranty or representations of any kind, whether express or implied. CANCELLATION AND REFUND POLICY 

In case of online consultation or any other services a customer will be eligible to raise a request for Refund only in case the consultation query is not replied within 24 ( Twenty-four) hours timeline. or customer is not satisfied with  other services.
The customer is required to raise the Refund request with AGRILIP TECHNOLOGY  PVT LTD (poultry zippy ) customer care within 72 (seventy-two) hours from the time of submission of query or receiving of response. The request for the Refund will be validated by poultry zippy  customer care team.
In case of valid Refund, the same will be done by crediting the bank account of the customer. Refund process shall be completed within 15 (fifteen) days from the date of submission of the request for Refund.
